What are we supposed to make of that phone conversation between Roger Clemens and Brian McNamee? Even though McNamee comes across as contrite, he also never actually admits to doing anything wrong. The whole thing was just pretty strange -- and if it left you confused, you're not the only one. From the AP:"We played it back, trying to decide, 'What do we do now? What is he saying?''' [Clemens' lawyer Rusty Hardin] said. "There is a 90-percent view of the people around Roger that (McNamee) was trying to set Roger up. Roger thought that maybe McNamee was really trying to say, 'I'm ready to come clean.'Honestly, the whole situation smells funny to me. McNamee never realized that the call was being recorded, nor did he know that Clemens had lawyers in the room telling him what he was and wasn't allowed to say. In fact, the reason McNamee used to reach out to Clemens via email asking to talk was because he wanted Clemens to talk to McNamee's son, who is very ill. (McNamee wanting Clemens to speak to his son seems odd in itself, until you realize that Clemens' and McNamee's families were at one point very close). It's kind of ironic that Hardin was worried that Clemens was being set up considering they were quite obviously trying to set up McNamee.
"We couldn't figure it out. That's why we finally opted to just send back an e-mail saying we're not comfortable talking to you any more unless you get permission from your lawyers, OK? Because we couldn't tell what he was doing.''
Before the call, Clemens had been warned not to say anything that could get him accused of tampering with a federal witness, which is why Hardin said Clemens steered clear of telling McNamee what he wanted him to do.
All in all, it's just ... strange. I honestly can't recall another situation in sports that even compares to this.

To,me this was nothing but an orchestrated DANCE by two people in WHO CAN SAY the MOST of the least. Prior to this, people were talking about HIS AGE and increase in other body dimensions ( what is he 45?). If exercise and good health are THE ONLY reasons why he was so successful, WHY IS IT JUST LIMITED TO HIM and not other pitchers over 40?
I still think this guy is a Hall of Famer, but I tend to believe George Mitchell's report over him ANYDAY OF THE WEEK. How many other athletes have PUBLICALLY DECLARED THEIR INNOCENCE only to be FOUND GUILTY IN THE END?

There is one moment in the conversation that clemens clearly is doing his best to persuade his old body to change his tune or story .
Circumstantial evidence has been use as a tool in the legal profession for a long time.
Signs or facts on which a conclusion can be based;
To indicate clearly on a fair and explicit way .

The phone call was incredible bulls**t on a cosmic level. Everyone knows this but unbelieveably some still come to his defense. I won't even touch upon the fact that had this situation been reversed and a person of color were involved, the media and bloggers would have had a field day with this. He's guilty & everyone knows it.

that phone call was a joke. to me clemens lawyer made a huge mistake by airing it. it sounded like it was killing mcnamee to implicate roger. baseball is a joke and so are the records set during the steroid era. they should be thrown in the trash

If I were a betting man, I would wager on Roger having used enhancers. However, he never tested positive. You are taking the word of an individual who doesn't have a lot to gain but he can sure lose a lot, freedom, fines etc. Would I be willing to deny Clemens the Hall of Fame based on the Mitchell Report? I don't think so. Give me some sound and verifiable proof and chances are I would change my thinking. And until they get their hands on this proof, Rogers a go.

Of all the people listed on the Report Clemens is the only challenger. He is as guilty as sin. He & his lawyer are trying get McNamee, Clemens' old pal, to cut him some slack. I believe that McNamee told the truth. Clemens can't lie his way out of this one. What a dumb phone call.

I think the biggest issue here is the he said-he said scenario. To all of our knowledge at this point, there's no evidence, no drug tests, no paper trail, nothing, that indicates Clemens is guilty other than McNamee's word.
So regardless of what any of us believe, Clemens will only ever be guilty in the court of public opinion, and that's about it.
Even if Clemens did use steroids or HGH or whatever, he couldn't have been an abuser because his body really didn't change over his 25-year career. Game On! put a shot of Clemens in Boston next to a shot of Clemens in New York this year and I don't see a difference other than age.

As to the circumstantial evidence thing, an article on the website lawsuite.net says that since Brian wanted him to talk to his son, maybe his silence (in the face of Roger’s self-serving comments “I was clean...remember!) was like letting a bad pitch go by... Ball four Roger.

Lets all remember a year or so ago espn report that roger clemens among others were named by that diamondback player. That was the first time anyone said anything about clemens.everyone convicted him then,and it was also probally why mitchell focused on him. When unsealed THERE WAS NO MENTION OF HIM!! Cansanco nothing, balco nothing, game of shadows nothing, not one player, no evidence where he got the steroids, no evidence where he got the hgh. Now all you hear is how he got better as he got older thats crap at best he maintained a high level but his numbers were not better in new york or toronto than in boston.except in new york he had a better team around him and people made plays behind him. He is not a body builder. if you take steroids and work out as hard as clemens has for 25 years you would have mucsle on top of muscle thats a fact look at the others. Now look at Mcnamee his crediblity is bunk!! He sat down and they said we want clemens and if you don't help you go to jail. why would they you say that because the had nothing new and no real big names we did not know about already.without clemens the mitchell report is junk. I am not a hugh clemens guy but the evidence just is not there.Bonds went from 30 home runs to 70 plus.and you can name 100 guys like him. Everyone showed large increase in proformance and size, and we can see them linked to a source of the product. On the other hand Clemens stayed consistent and has never been liked to a source of steriods or hgh. Even Mcnamee said he never provide steriods just injected them. That case would not stand up in any court and should not in the court of public opinion either.

Roger repeats that "someone is going to have to tell the truth," several times.
That someone is Roger. He was clearly speaking of himself in the third person because McNamee didn't even think that the request applied to him--as he (Mcnamee) was already telling the truth.
To those that need more proof before banning Clemens to the hall--wait until Congress grills Rog. But even if sworn testimony is all they have--sworn testimony, when corroborated by Pettite and receipts,
is plenty good enough.
Roger has already lied about getting injected by anything at all by McNamee--now it's B-12 and lidocaine. And Roger lied about when he knew he was going to be in the Mitchell report.
That's 2 lies...and counting.
